3. HOW TO SUBMIT A DMCA TAKEDOWN NOTICE
If you are a copyright owner or a person authorized to act on behalf of the copyright owner, and you believe that your copyrighted work has been reproduced, distributed, or displayed on our Site without authorization, you may submit a formal DMCA Takedown Notice.
To be valid under the DMCA (17 U.S.C. § 512(c)(3)), your written notice must include all of the following elements:

4. OUR RESPONSE TO A VALID DMCA NOTICE
Upon receipt of a DMCA Takedown Notice that substantially complies with the requirements outlined in Section 3, Real Bounce will take the following steps:
- Prompt Removal or Disabling of Access: We will act expeditiously to remove or disable access to the material claimed to be infringing.
- Notification to the User: If the allegedly infringing material was posted by a specific user, customer, or third party, we will make a reasonable effort to notify that individual that the content has been removed or disabled, providing them with a copy of the DMCA notice (with your personal contact information redacted, if necessary) and a link to this DMCA Policy.
- No Liability for Removal: Real Bounce shall not be liable to any person or entity for any claims, damages, or losses arising from our good-faith removal or disabling of access to material pursuant to this policy.
5. COUNTER-NOTIFICATION PROCEDURE
If you are a user of our Site and you believe that material you posted was removed or disabled as a result of a mistake or misidentification (e.g., the material is not infringing, you own the rights to the material, or your use constitutes “fair use”), you have the right to submit a DMCA Counter-Notification.
To be valid under the DMCA (17 U.S.C. § 512(g)(3)), your written Counter-Notification must include all of the following elements:
- Identification of the Removed Material: A description of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled (e.g., the original URL).
- Statement of Good Faith: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification.
- Consent to Jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if your address is outside the United States, for the District of Vermont), and that you will accept service of process from the person who provided the original DMCA Takedown Notice or an agent of such person.
- Signature: Your physical or electronic signature.

Our Response to a Valid Counter-Notification
Upon receipt of a valid Counter-Notification, Real Bounce will promptly forward a copy to the original complainant. We will inform the complainant that we will replace the removed material or cease disabling access to it within ten (10) to fourteen (14) business days, unless the complainant notifies us that they have filed a court action seeking a restraining order against the user. If we do not receive such notice from the complainant within that timeframe, we may, at our sole discretion, restore the material to our Site.
6. REPEAT INFRINGER POLICY
Real Bounce is committed to combating copyright infringement. In accordance with the DMCA and other applicable laws, Real Bounce has adopted and implemented a policy that provides for the termination, in appropriate circumstances, of users, customers, or account holders who are deemed to be repeat infringers.
If a user is found to have repeatedly uploaded, posted, or transmitted infringing content, or has been the subject of multiple valid DMCA Takedown Notices, Real Bounce reserves the right to:
- Remove the infringing content without prior notice.
- Suspend or terminate the user’s access to our Site, services, or rental accounts.
- Cancel any pending reservations or bookings.
- Pursue any available legal remedies.
The determination of what constitutes a “repeat infringer” is made at the sole discretion of Real Bounce management, based on the facts and circumstances of each case.
7. WARNING REGARDING FALSE CLAIMS
Please be aware that under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing, or who knowingly materially misrepresents that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees, incurred by the alleged infringer, the copyright owner, or the service provider (Real Bounce).

8. INTELLECTUAL PROPERTY OWNERSHIP OF REAL BOUNCE CONTENT
Unless otherwise noted, all content on the Real Bounce website, including but not limited to text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the exclusive property of Real Bounce or its content suppliers and is protected by United States and international copyright, trademark, and other intellectual property laws.
The compilation of all content on this Site is the exclusive property of Real Bounce. You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of our Site or its content without the express written permission of Real Bounce.
Exception: Customers and event participants may share photographs or videos of their events featuring Real Bounce Equipment on personal, non-commercial social media accounts, provided that such sharing does not imply endorsement by Real Bounce and does not violate any other terms of our rental agreement.
9. MODIFICATIONS TO THIS POLICY
Real Bounce reserves the right to modify, update, or amend this DMCA Policy at any time to reflect changes in our business practices, technological advancements, or changes in applicable law. Any changes will be effective immediately upon posting the revised policy on our Site, with the “Last Updated” date revised accordingly. Your continued use of our Site following the posting of changes constitutes your acceptance of such changes.
